Recent Developments in US Patent Litigation
Strategies for Venue after TC Heartland. Almost exactly one year ago, the US Supreme Court completely changed the venue rules for patent cases. Both patent owners and defendants have adopted new strategies in the wake of this case. We will discuss how patent owners are trying to avoid the implications of TC Heartland to hold on to their chosen venues; and how defendants are attempting to move cases to more favorable courtrooms.
ITC Litigation Mistakes – and how to avoid them. Activity is increasing at the ITC, including among Non-Practicing Entities. We have seen parties making some interesting choices, and mistakes. Most of these mistakes are avoidable. We will talk about how to avoid them.
The Future of the IPR. Just last month, the US Supreme Court issued its much-anticipated decision SAS Institute Inc. v. Iancu, limiting the discretion of the PTAB to issue partial institution decisions on IPR petitions. We expect this ruling to introduce greater uncertainty into the process. We will speculate about how this change in law will affect patent litigation cases, and the strategies parties may consider in response.

California: This activity has been approved for Minimum Continuing Legal Education credit by the State Bar of California in the amount of 1.5 hours in the General category. DLA Piper certifies that this activity conforms to the standards for approved education activities prescribed in the rules and regulations of the State Bar of California governing minimum continuing legal education.
New York: This nontransitional and transitional continuing legal education program has been approved in accordance with the requirements of the Continuing Legal Education Board for a maximum of 1.5 credit hours, of which 1.5 credit hours can be applied toward the Professional Practice requirement.
New Jersey: This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 1.8 hours of total CLE credit. Of these, 1.8 qualify as hours of credit toward the General category.
CLE credit will be applied for in other states where DLA Piper has an office except in Minnesota, North Carolina, and Pennsylvania.
