Dear AMCHAM Members,
As Korea continues to advance in technology and reforms, legal professionals and the presence of foreign law firms in Korea have also increased significantly in recent years. Korean lawyers now go through a graduate law school program similar to the United States. Korean jurists are also continuing to evaluate class action lawsuits and jury trial systems. Punitive damages are now recognized in some instances (e.g., protection of subcontractors). Mass tort litigation has also affected the tobacco industry, chemical industry, manufacturing industry and personal privacy. At the same time, the Korean judiciary lacks experience in handling such cases and the business community does not have sufficient case law precedent to meaningfully understand risks and obligations in Korea.
Scévole will share with us his international experience and observations in global litigation around the world. In addition, Scévole will discuss a trend in increased “litigation funding” initiatives in Europe and Asia-Pacific, which could have a substantial impact in Korea. If you’re interested about future litigation risks and obligations in Korea, and how you can contribute to shape the future of Korea, then you’ll want to have your breakfast with us on Nov. 7.
