Disputes are a natural part of operating a business even though many businesses can be poorly prepared to properly manage them. Disputes can affect a business' financial performance, the morale of its people and impact upon its reputation in the community. How you manage disputes can go a long way to determining whether you achieve a satisfactory outcome.
In-house counsel are often the people left to deal with disputes when things go wrong and to manage the company and the management's expectations.
Using the context of an international commercial arbitration, this session will focus on the key decision points that typically arise for in-house counsel that can have an impact on how effectively they manage a dispute. The session will look at key decision points such as the decision as to type of dispute resolution clause in the contract, the decision on external counsel and the type of tribunal when a claim manifests, the decision on when to consider settlement and where and how to enforce a successful award. The session will provide you with some strategies to achieve the best available outcome at every key decision stage.
